Terms of Service

1 Pricing and Payment

The client pays the photographer (Matias Halttunen) the total amount for the photography that has been agreed verbally or in writing. The total amount will be paid in two installments as follows. The first part is the booking fee, which is billed when the customer books the photoshoot for a specific day. The first installment amounts to 25 % of the price of the photoshoot and reserves the photoshoot for the agreed time. If the client cancels the photoshoot, the payment for the first installment will not be refunded because the photographer has refused all other job offers for that day. If the customer changes the time of the photoshoot, the first part of the payment will not be refunded. The remaining 75 % is due one week before the date of the photoshoot. If the payment has not been made before the date of the photoshoot, the photographer has no obligation to photograph or refund the first part of the payment.

1.1 Payment Methods

 

Acceptable payment methods currently are: Invoice (Email or Paper mail), e-invoice, wire transfer, cash, MobilePay and Pivo.

 

 

1.2 Installments

 

 

The photographer can agree with the client to pay the remaining part (75%) in 2-6 installments. The price of the photoshoot must be paid in full one (1) week before the planned photoshoot date. If the full payment has not been made before the day of the shoot, the photographer has no obligation to photograph or return any money that has already been paid.

1.3 Travel Expenses

​

Travel expenses within Lahti area are included in all packages. Otherwise travel expenses are 0,53€/km.

1.4 Late Payment

​

Each invoice has a 14-day payment period. If the payment is not made on time, the photographer will contact the customer before sending a reminder invoice. If the customer has not paid the invoice in sufficient time after being contacted, the photographer will send a reminder invoice.

2 Delivered Items

​

​

2.1 Wedding Photographs

​

All images will get basic retouch, which in this context means that photos are retouched for exposure, white balance, contrast, color, and cropping. More detailed processing (such as removing objects from the image or smoothing the skin) is not included in the service without extra charge. The number of photos from the wedding ceremony and wedding party will be delivered according to amount that has been agreed on.

​

In addition to the standard images, possible photobooth photography should be agreed separately due to the increase in the number of images, which should be taken into account when pricing as a factor that increases the amount of the total price. Due to the fast-paced nature of the wedding and the unpredictable movements of the guests, no single event is guaranteed to be filmed. The photographer is not liable if a particular event has not been photographed. Photos will be submitted no later than six weeks after the wedding. Images will be primarily delivered through a web-gallery.

2.2 Portraits

 

All portrait packages (Milieu, Formal, Family and Wedding portraits) include 10 fully retouched, full resolution photos. The photographer delivers portraits with basic retouch through a cloud service (WeTransfer), from which the customer will choose the agreed amount of photos, which are then given a more precise retouch. For these photos, photo manipulation can also be performed if necessary. The customer has four weeks after being submitted the link to the cloud service to select the portraits to be retouched. If the customer does not make selections within the given time, the photographer has the right to choose 10 portraits for delivery without further retouching. Images will be primarily delivered through WeTransfer.

If the client wants to include more photos than is included in the package, a larger number of photos to be delivered in the package can be agreed with the client in writing.

2.3 Other Photographs

​

In all others photography such as event, Promotional, concert, vehicle and apartment photography, the number of images, price, and delivery will be agreed in writing with the customer. Image retouching is also agreed separately with the customer.

2.4 Web-Gallery

​

When photos are delivered through a web-gallery, the gallery will be kept private and password protected for a period of three weeks. During that time the photos are available for the client to download. After the three week time period the gallery will become public, unless otherwise agreed. In some photoshoots (such as large documentary wedding day photography) only a part of the delivered photos will be left on display in the gallery.

3 Copyright

​

The photographer will retain every right to the photographs and he may use the images in his portfolio, blog, social media, and in other marketing related to his work without separate permission. The client will receive a worldwide, perpetual non-commercial license to the images submitted, which will be passed on to your descendants. The client may publish images, use the images to make prints and other physical products for any non-commercial purpose. The client is not allowed to edit or retouch the images in anyway. For commercial purposes, a separate license must be negotiated with the Photographer.

4 Style, Backup and Possible Destruction of Photos

 

 

The client has seen the photographer’s previous work, but accepts that the photographers style may change over time or due to circumstances. The photographer does not guarantee that the images will be similar in style to the previous images. The photographer decides the artistic style of the images according to the prevailing circumstances at his own discretion. The choice of images to be submitted is entirely at the discretion of the photographer. Images are delivered in JPG format without watermark. Raw image files (RAW format) will not be delivered. The customer does not have the right to see all the pictures taken on the day of the photoshoot if in the opinion of the photographer, they are not good enough technically or artistically.

 

If the images are completely or partially destroyed for a reason beyond the control of the photographer, such as a hardware failure, the photographer is liable for damages up to the amount paid for the service. However, the photographer is responsible for the careful backup of the images. The backup obligation ends 6 months after the delivering of the images. The photographer has no obligation to keep the client's images after that.

5 Agreement to Contract and Termination

 

 

The contract is formed when the customer books the Photographer for a certain day and the reservation fee has been paid. At the same time, the customer undertakes to comply with the terms and conditions for the photography and the use of images mentioned in this document.

 

The customer has the right to terminate the contract in writing 1 month before the photoshoot without additional cost. For cancellations made less than 1 month before the photoshoot, the photographer will charge 50% of the total price. After termination of the contract,  the photographer has no obligations to the customer and no money already paid will be refunded. The photographer has the right to terminate the contract if the customer agrees to terminate the contract in writing OR unilaterally, only if there is an insurmountable obstacle.

 

An insurmountable obstacle means a situation that is unpredictable and that causes the photographer to be physically unable to photograph the wedding due to, for example, a serious injury or death. If the photographer is unable to arrange another photographer in the event of an insurmountable obstacle, he is obliged to refund all money paid. In that case, the photographer is not obliged to pay for any additional damages.

6 Applicable Law and Settlement of Disputes

 

 

Finnish law will be applied to these terms of service. Disputes arising from the terms of service will be resolved through mediation. Ultimately, disputes will be resolved in the Lahti District Court.

7 Additions and Changes

 

​

All additions and amendments to the contract must be made in writing.
